UN Photo\/Jean-Marc Ferr\u00e9<\/div>\n<div id=\"fullstory\">\n<div id=\"___plusone_0\">6 May 2013 \u2013 The United Nations human rights chief today welcomed the birth of a new mechanism which will empower individuals to seek out justice when their rights to food, adequate housing, education or health are violated.<\/div>\n<\/div>\n<p>The new measure, which came into force on 5 May, is known as the\u00a0<a href=\"http:\/\/www.ohchr.org\/EN\/ProfessionalInterest\/Pages\/OPCESCR.aspx\"><i>Optional Protocol to the International Covenant on Economic, Social and Cultural Rights<\/i><\/a>. It will allow individuals or groups to file a complaint with the UN if their rights are infringed by a Member State that is party to the Protocol, lifting these rights to equal standing with all other human rights protected within the panoply of international law.<\/p>\n<p>In a\u00a0<a href=\"http:\/\/www.ohchr.org\/EN\/NewsEvents\/Pages\/DisplayNews.aspx?NewsID=13300&amp;LangID=E\">statement<\/a>\u00a0celebrating the occasion as \u201ca major advance,\u201d UN High Commissioner for Human Rights, Navi Pillay, voiced hope that the Protocol would finally fill a long-time gap in international law.<\/p>\n<p>\u201cEgregious violations of economic, social and cultural rights are occurring, often unnoticed, on a daily basis, which in the area of civil and political rights would have been immediately condemned,\u201d said Ms. Pillay in a news release.<\/p>\n<p>\u201cThis Protocol will help to address this imbalance.\u201d<\/p>\n<p>According to the Protocol, citizens of signatory nations will be permitted to appeal to the UN\u2019s Committee on Economic, Social and Cultural Rights on specific rights-related cases after they have exhausted all attempts to find justice in their respective countries.<\/p>\n<p>In addition, the Protocol grants the Committee authorization to conduct inquiries if it receives reliable information indicating \u201cgrave or systematic violations by a State party of any of the rights covered by the Covenant,\u201d the statement read.<\/p>\n<p>\u201cI am confident that these mechanisms will make it possible for the Committee to assist States and other stakeholders to get to the root causes of violations of economic, social and cultural rights,\u201d the High Commissioner continued.<\/p>\n<p>The Protocol took effect three months after Uruguay became the required tenth country to ratify it \u2013 joining Argentina, Bolivia, Bosnia and Herzegovina, Ecuador, El Salvador, Mongolia, Portugal, Slovakia and Spain.<\/p>\n<p>Ms. Pillay welcomed Uruguay\u2019s signing back in February and urged other States among the 160 that are already party to the Covenant to ratify the Optional Protocol as soon as possible.<\/p>\n<p>\u201cThe Protocol makes a strong and unequivocal statement about the equal value and importance of all human rights and the need for strengthened legal protection of economic, social and cultural rights in particular,\u201d Ms. Pillay stated.<\/p>\n<p>&nbsp;<\/p>\n<p>\u2013<a href=\"http:\/\/www.un.org\/apps\/news\/story.asp?NewsID=44835&amp;Cr=human+rights&amp;Cr1#.UYlhaqKG1rO\" target=\"_blank\">UN<\/a><\/p>\n<hr \/>\n<p><strong>News Tracker: past stories on this issue<\/strong><\/p>\n<p><a href=\"http:\/\/www.un.org\/apps\/news\/story.asp?NewsID=44081&amp;Cr=cultural&amp;Cr1=rights\">UN lauds new tool enabling individual complaints on economic, social and cultural rights<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>High Commissioner for Human Rights Navi Pillay.
